Terms of Use Agreement
General
By clicking “Sign Up Now”, “Become a chainstaff Member”, “Register”, or by accessing or using any of our services, you enter into a legally binding agreement with chainstaff AG, Switzerland (“chainstaff”, “we”, “us”, or “our”).
If you do not agree to these Terms, do not access or use our Services. You may terminate this agreement at any time by closing your account and discontinuing your use of the Services.
Services
These Terms apply to chainstaff.info, chainstaff apps, and any related websites, plugins, or digital services that refer to these Terms (collectively, the “Services”). This includes offsite data collection for such Services, such as analytics or advertisements, and plugins like “promote with chainstaff” or “share via chainstaff”.
Registered users are Members, while unregistered visitors are Visitors.
Your Relationship with chainstaff
You are entering this agreement with chainstaff AG, Mohnstrasse 1, 3084 Wabern, Switzerland.
As a Visitor or Member, your use of the Services and any related data processing are governed by our Privacy Policy, our Cookie Policy, and any other documents referenced therein.
Modification
We may amend these Terms, our Privacy Policy, or Cookie Policy from time to time. If we make material changes, we will notify you through our Services or by other means, giving you an opportunity to review them before they become effective.
No changes will apply retroactively. If you disagree with any updates, you may close your account. Continued use of the Services after notice of changes constitutes acceptance of the updated Terms.
Eligibility and Access
Our Services are not intended for individuals under 16 years of age (“Minimum Age”).
By using the Services, you confirm that:
- You have reached the Minimum Age required by applicable law.
- You maintain only one account under your real name.
- You have not been previously banned from using chainstaff.
If local law requires a higher age for lawful processing of your data or use of online services, the higher age shall apply.
All users, including companies, mediators, and applicants, are responsible for ensuring that all shared or posted content (including job ads and referral links) is lawful, accurate, and ethical.
Account Types and Responsibilities
There are three types of Members on chainstaff:
- Mediators (chainstaffers) – users who share job listings.
- Companies – representatives who post job openings.
- Applicants – professionals applying for open positions.
As a Member, you agree to:
- Choose a secure password and keep it confidential.
- Not transfer or sell any part of your account.
- Comply with applicable laws, these Terms, the chainstaff Code of Conduct, and Community Guidelines.
- Use the platform responsibly and in good faith.
You are responsible for all activity under your account, unless you close it or promptly report misuse. chainstaff is not responsible for the accuracy of job postings or the conduct of mediators or companies. Users agree to indemnify and hold chainstaff harmless from any claims, damages, or liabilities arising from misuse of the platform.
Payments and Bounties
When purchasing paid Services or posting a job with a bounty, you agree to pay the applicable fees and taxes to chainstaff.
Payments and bounties are governed by the following principles:
- A 30% service fee is retained by chainstaff from the bounty amount.
- The remaining bounty is distributed among eligible participants upon successful hiring via chainstaff.

The bounty is released in five equal installments:
- Upon confirmed contract signing.
- At the start of employment.
- At the beginning of the 2nd month of employment.
- At the beginning of the 3rd month.

At the beginning of the 4th month.
chainstaff reserves the right to adjust payment procedures as appropriate. No bounty is due for withdrawn job postings or unsuccessful hires. chainstaff may withhold the first installment until the candidate has started employment, to prevent fraud or abuse.
Refund Policy
If a candidate does not start employment or the contract ends within the first five months, the corresponding remaining installments will be credited pro rata to the company’s chainstaff account balance.
If the company requests a bank refund, processing fees may apply. Payment disputes must be reported within 30 days of the transaction.
Notices and Communication
You agree that we may contact you:
- Within the platform, or
- Via the contact information you provide (email, phone, or mailing address).
You are responsible for keeping your contact details accurate and up to date.
Member Responsibilities and Conduct
As part of the chainstaff community, you agree to act ethically and professionally. You may not:
- Create false identities, impersonate others, or misrepresent your affiliation.
- Scrape, crawl, or copy content without permission.
- Post or distribute malicious code.
- Misuse referral links or spam third parties.
- Claim affiliation or endorsement by chainstaff without written consent.
- Violate privacy, intellectual property, or data protection laws.
- Interfere with or overload our Services.
Users are expected to share job opportunities responsibly and refrain from any conduct that may harm the platform or other members.
User Compensation and Independent Status
chainstaff provides a digital platform that connects companies, mediators, and applicants. We do not employ mediators, referrers, or applicants, all Members act independently and at their own discretion. chainstaff does not control how, when, or where Members use the platform.
Any rewards or bounty earnings you receive may, under certain circumstances, be subject to income tax, self-employment contributions, or other obligations under applicable law. You are solely responsible for reviewing and complying with any such requirements in your country of residence. chainstaff does not withhold taxes or make social security deductions on your behalf. If you engage in frequent or regular referral activity, it could be interpreted as self-employment under applicable law.
It remains your responsibility to determine and comply with any registration, reporting, or licensing requirements that may apply to such activity.
Intellectual Property
You retain ownership of any content or information you post on the Services. By posting or submitting such content, you grant chainstaff a worldwide, non-exclusive, transferable, sublicensable license to use, copy, modify, distribute, publish, and process that content in connection with the Services, without further notice or compensation to you.
You may delete your content or close your account at any time. However, content shared with others may remain accessible until deleted by them or removed from backups. We do not include your content in third-party advertising without your explicit consent.
Availability and Maintenance
We may change, suspend, or discontinue any Service at any time. We do not guarantee storage or continued availability of any content. chainstaff is not a storage service and assumes no obligation to retain data except as required by law.
Third-Party Content and Services
Our platform may contain links or integrations to third-party websites, apps, or services. chainstaff is not responsible for their content, accuracy, or performance. Your interactions with third parties are solely between you and those parties.
Automatic Processing and Recommendations
We may use information you provide to personalize your experience. For example, by suggesting job opportunities or potential matches. Maintaining accurate and complete profile data helps improve the relevance of these features.
Disclaimer of Warranties
chainstaff provides the Services “as is” and “as available”, without any express or implied warranty. We do not guarantee that the Services will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, chainstaff disclaims any implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, chainstaff and its affiliates are not liable for:
- Lost profits or business opportunities,
- Reputational harm,
- Loss of data, or
- Any indirect, consequential, incidental, or punitive damages.
Total liability under these Terms shall not exceed the total amount paid by you to chainstaff in the twelve (12) months preceding the event giving rise to the claim.
Termination
Either you or chainstaff may terminate this agreement at any time. Upon termination, you lose access to your account and any Services.
The following provisions remain effective after termination:
- License rights previously granted to chainstaff.
- Members’ rights to re-share your content.
- Sections concerning limitation of liability, indemnity, and governing law.
- Any outstanding payment obligations.
You may close your account at any time through your account settings.
Governing Law and Jurisdiction
This Agreement is governed by the laws of the Swiss Confederation, excluding its conflict-of-law rules. Exclusive place of jurisdiction for all disputes shall be Köniz, Canton of Bern, Switzerland, to the extent legally permissible. If you access chainstaff from outside Switzerland, you are responsible for compliance with local laws.
If any provision of these Terms is found to be invalid, the remaining provisions remain in force. Invalid clauses shall be replaced by provisions that best reflect the original intent of the parties.
Miscellaneous
If any term of this Agreement is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable while preserving its intent. Failure by chainstaff to enforce any right under this Agreement does not constitute a waiver.
You may not assign this Agreement without our consent. chainstaff may assign these Terms to its affiliates or successors without prior notice.

- Engage in spam, fraud, or manipulative behavior.
- Misrepresent your affiliation with chainstaff.

This privacy policy informs you about the nature, scope, and purpose of the processing of personal data (hereinafter referred to as "data") within our website www.chainstaff.info ("website") and our mobile & desktop app ("app"; together referred to as "online services").

General Data Processing
We only process personal data of our users as necessary to provide a functioning service and to deliver the services we offer, adhering to the principle of data minimization. The processing of personal data of our users generally occurs only with the user's consent or based on other legal regulations that allow data processing. You have the right to access, rectify, or delete your personal data. Additionally, you can restrict processing, request data portability, and object to data processing. We also process personal data for statistical and market analysis purposes. For example, statistics on industry affiliation, location, market area of website visitors are created and evaluated in anonymized form. Details can be found in the respective sections of this privacy policy. For special services (e.g., sending newsletters), additional privacy notices may apply. We will inform you about these at the beginning of the use of the respective service. We collect data from companies, mediators, and candidates, including contact details and job application information. This data is used to facilitate job postings, application processing, and communication with hiring companies.
Data Deletion and Duration of Storage
As a principle and unless otherwise specified, your personal data will only be stored as long as necessary for the purpose of collection and storage, with a maximum of six months post-application process. According to your consent, data can be stored longer, as long as you do not revoke your consent. Storage may also occur if this has been provided by the European or national legislator in EU regulations, laws, or other provisions to which we are subject. This is the case, for example, for billing data, which must usually be stored for at least 10 years. If data is stored based on such a legal regulation, its processing will accordingly be restricted, i.e., the data will no longer be processed for any other purposes for which they were collected. A blocking or deletion of the data also takes place when a storage period prescribed by the mentioned standards expires, unless there is a necessity for further storage of the data for a contract conclusion or contract fulfillment. You may withdraw your consent at any time by emailing hello@chainstaff.info.
Transfer to Third Countries
All data processing operations take place within the EU or the EFTA states. Data transfers to third parties occur only based on GDPR compliance. All third-party processors are contractually obligated to adhere to our data protection standards.
General Data Usage for Website Provision and Creation of Log Files
When you access our website, we automatically store usage-related data about the usage process. This includes especially the IP address, the visited URLs, the duration of the visit, the operating system used, the browser used, and the amount of data transferred.
We collect this data to ensure the provision of our website. Additionally, they are used to anonymously analyze, store, and evaluate user behavior to continuously improve and further develop the service. Further details on the systems used can be found in the sections below on cookies and social media.
Your IP address is stored in the log files as far as necessary for security purposes. Moreover, your IP address is hashed, making it impossible for us to trace back to your connection or device. The purposes mentioned also represent our legitimate interest, which justifies the data processing according to Art. 6 Para. 1 lit. f) GDPR. The basis for processing is Art. 6 Para. 1 lit. f) GDPR.
Data Processing for Profile Creation
Creating a User Profile as an Employer
- Within our app, you have the option to create a profile to publish job advertisements and find suitable candidates. For this purpose, the following data is required: first name, last name, company (for legal entities), contact details (incl. email address and password, telephone number), address, billing address, registration data, company, and job descriptions. Additional data can be provided voluntarily.
- The aforementioned required data are necessary to ensure that the user profile functions as intended and can be attributed only to you. The collection and processing of personal data in this context are justified by the performance contract we conclude with you. If you do not provide us with this data, we cannot set up a user profile for you and cannot provide our associated services.
- Job applications are reviewed by chainstaff and securely shared with hiring companies via Notion or another suitable solution. We ensure data is handled in compliance with privacy laws and secure data transmission practices. The basis for processing is Art. 6 Para. 1 lit. b) GDPR.
Creating a User Profile as a chainstaffer ("mediator")
- Within our application, we offer users the opportunity to create a profile by providing personal data. The data is entered into an input mask and transmitted and stored by us. Data is not passed on to third parties unless they explicitly apply for an open position, thus releasing their data to the employers advertising the position. The processing of data occurs exclusively for the purpose of providing the user profile and its associated functionalities.
Creating a User Profile as a Candidate
- Within our app, you have the option to create a profile to view job advertisements and participate in application processes. For this purpose, the following data is required: first name, last name, contact details (incl. email address and password, telephone number), address, photo, resume (including date of birth), and other application-relevant information (e.g., academic degrees, special skills and abilities, work experience, etc.). Additional data can be provided voluntarily.
- If you create a user profile with us using your LinkedIn account (login via LinkedIn), we collect the information you have provided on LinkedIn and link it to your user profile on chainstaff.
- The aforementioned required data are necessary to ensure that the user profile functions as intended and can be attributed only to you. Additionally, we can only consider you for suitable job advertisements and let you participate in application processes based on this data. The collection and processing of personal data in this context are justified by the usage contract we conclude with you. If you do not provide us with this data, we unfortunately cannot set up a user profile for you and cannot provide our associated services.
- If you have created a user profile with us, we check the currency of the data you have provided over time by comparing it with the public profiles you have specified (e.g., on LinkedIn). If we find that your profile on chainstaff is no longer current, we will actively contact you. The basis for processing is Art. 6 Para. 1 lit. b) GDPR.
Participation in an Application Process as an Employer
If you decide to unlock suitable candidates for your job advertisement, the data mentioned under section 1.1 about you will be disclosed to such candidates. Disclosure is necessary to facilitate contact between employers and candidates. The basis for processing is Art. 6 Para. 1 lit. b) GDPR.
Participation in an Application Process as a Candidate
If you wish to participate in application processes, the data mentioned above about you will be disclosed to employers who have published a job advertisement. Disclosure is necessary to facilitate contact between employers and candidates and is therefore justified by the usage contract we have concluded with you. If you access a job advertisement published by us via a link within a social network (e.g., LinkedIn), we collect and store the following information that you have made publicly available in the respective social network: first name, last name, referrer URL, employer, and job title, accessed job advertisement. We need this information to ensure that you do not apply for the same position multiple times and that you are not approached multiple times regarding the same position. The basis for processing is Art. 6 Para. 1 lit. b) GDPR.
Further Processing Based on Legal Obligations
In addition, we collect, store, and process personal data related to your use of our online services if we are obligated or authorized to do so by relevant legal regulations. This is the case, for example, with billing data that we need for proper accounting. The basis for processing is Art. 6 Para. 1 lit. c) GDPR.
Data Transmission When Contacting Us
If you contact us via the contact form on the website or through the online services, we collect the following personal data: name, email address, telephone number. We use this data exclusively to respond to your contact. Further processing does not occur. If you do not provide us with this data, unfortunately, we cannot process your request. The basis for processing is Art. 6 Para. 1 lit. b) GDPR.
Data Processing When We Contact You
If you maintain a publicly accessible professional profile on our platform or a designated platform (e.g., LinkedIn), we may contact you regarding job advertisements that match your profile. Contact is made exclusively through the communication means provided within the respective platform (e.g., in-app messages). If you show interest in our offer, we store the publicly accessible information from your professional profile to offer you the most suitable job offers. In this case, the basis for processing is the (pre-)contractual relationship with you according to Art. 6 Para. 1 lit. b) GDPR. If you are not interested in our offer or do not respond, we will not store any data about you. Only the publicly accessible information that you have independently entered in your chainstaff user profile will be retained.
Data Analysis
To continuously improve our offer, we analyze the data available to us on applications, inquiries, job advertisements, etc. The analyses are carried out for the purpose of business evaluations, marketing, and market research. We may consider user information along with details, e.g., about their used services. The analyses serve us to increase user-friendliness, optimize our offer, and business efficiency. The analyses are carried out solely for us and are not conducted via external service providers. They will not be disclosed to third parties unless they are anonymous analyses based on aggregated values.

Your Rights
Users have the right to access, rectify, or delete their personal data. To exercise these rights, users can contact our support team. If your personal data is processed, you are a data subject within the meaning of the GDPR, and you have the following rights against the controller:
- Right of access – You have the right to request information about the personal data we process or store about you.
- Right to rectification – You have the right to request the correction or completion of incorrect or incomplete data concerning you.
- Right to erasure – Under certain circumstances, you have the right to request the deletion of your data from us.
- Right to restriction of processing – You have the right to request us to restrict the processing of your data under certain circumstances.

- Right to data portability – You have the right to request that we transfer your personal data to another controller or to you under certain circumstances.
Your Right to Lodge a Complaint
You also have the right to lodge a complaint with a data protection authority. If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing. If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.
Changes to This Privacy Policy
Due to the dynamic development of the internet, new technologies and opportunities are continuously evolving. To allow you to benefit from these technologies and opportunities, we reserve the right to change this privacy policy for the future upon the introduction of new, additional services or changes or extensions to existing services or service elements. Insofar as the change to the privacy policy affects only the general use of data and not the use of data within the context of a user profile, the new privacy policy will apply from the date of its update on the website. A change to the privacy policy that relates to the use of data already collected and stored for the sending of newsletters will only occur if it is reasonable for you.
